Federal Court Upholds Winner-Take-All Electoral Vote In Texas

A federal appeals court is upholding the constitutionality of the winner-take-all system Texas uses to allocate electoral votes for president. The 5th U.S. Circuit Court of Appeals made the ruling on Wednesday. The League of United Latin American Citizens sued the state in 2018, claiming the system violates the one-person, one-vote standard, making millions of votes irrelevant in presidential races. The plaintiffs wanted the state's electoral votes to be awarded to candidates proportionally. The court rejected the lawsuit's claim. Texas is one of 48 states that employ the winner-take-all method.
